I regret to inform you that I have received a complaint alleging that you are responsible for causing a noise nuisance. This is intended to draw your attention to the complaint and to acquaint you with the law on statutory noise nuisance contained in the above Act.
At the moment, I have no way of knowing whether or not the complaint is justified. However, you will appreciate that the County Council has a responsibility to investigate such complaints. Which may include surveillance to be undertaken to either prove or disprove the allegations. The Council has a statutory duty to take formal action where it is confirmed that a noise nuisance exists.
Where applicable, tenancy enforcement action may be considered by landlords i.e Local Authority, Housing Associations if those responsible are found in breach of their tenancy conditions.
I am sure that it is not your intention to cause annoyance to anyone, and you may not even be aware of the problem. However it is clearly in your own interest to ensure that there is no cause for complaint.
Should complaints continue to be received and Officers witness the noise disturbance, we are required by law to serve an Abatement Notice, which will legally require you to control the noise failure to do so will result in legal proceedings against you. You should be aware that a person found guilty of causing a noise nuisance may be liable to a fine of up to £5,000 on conviction at a Magistrates' Court.
